Further to the discussion in our previous article regarding Bill 23’s proposed substantive changes to the Workers Compensation Act, Bill 23 has received Royal Assent as of August 14, 2020.

While the majority of the Bill’s provisions are now in force, sections 17, 18, 35, and 36, will come into force as of January 1, 2021. These sections pertain to the Bill’s amendments affecting the calculation of permanent partial disability awards and the determination, after the worker reaches age 63, of the worker’s effective retirement date if retiring beyond age 65.
