LRB Dismisses application for Provincial Goverment and BCPSEA Declared Single Employer

The BC Labour Relations Board has dismissed an application by the BC Teachers’ Federation (“BCTF”) to have the provincial government and BC Public School Employers’ Association (“BCPSEA”) declared a single employer. BCTF also alleged that BCPSEA and the provincial government had failed to bargain in good faith and sought an order requiring them to do so. The application had been filed in late January of this year, after BCPSEA rejected the last BCTF offer and less than a week before BCTF’s strike was ended by back-to-work legislation. The legislation imposed the terms of a new collective agreement (click here for earlier item). The Labour Relations Board ruled that the BCTF application was now moot as a result of the legislation. BCPSEA was represented by Harris & Company counsel.
