On December 10, 2002, the Minister of Justice Introduced Bill C-22, an act to amend the Divorce Act and other related legislation. The bill amends the Divorce Act to include a list of specific criteria for parents, lawyers and the judiciary to use in determining what is in the best interests of children. The terms “custody” and “access” will be eliminated from the Act. Instead, the courts will make “parenting” and “contact” orders. Through parenting orders, the courts may allocate “parenting time,” as well as decision making responsibilities regarding a child’s health care, education and other matters. The bill also contains several minor and technical amendments. According to the Minister, the reforms are “all about children. Children need their parents love, attention and financial support, as well as a safe environment. The Government of Canada recognizes that children’s needs come first after separation and divorce.”
