WorkSafe BC introduces online disclosure

WorkSafe BC has introduced a new online disclosure process which allows the parties to a WorkSafe claim to view file disclosure online, as well as access one another’s disclosure materials. This new process replaces the previous electronic or paper format.

It is important to note that the old CD ROM and paper format is no longer available to employers. Employers must sign up for an online account in order to access the online disclosure, which will be available for 60 days.

All information held by WorkSafe BC is subject to the Freedom of Information and Protection of Privacy Act (“FIPPA”). Employers should ensure that they have a privacy policy that complies with FIPPA and also with section 95 of the Workers Compensation Act, which prohibits unauthorized disclosure of claim file material.  It is recommended that an employer’s privacy policy clearly outline how both parties’ disclosure materials will be protected, as well as accessed. In addition, employers are responsible for designating which employees will have access to the new online service on the employer’s behalf.
